Location: Ontario,Canada Background: February 2023, I had been working for three months at a manufacturing shop when a new welder was hired. He came in with no mig tickets, but had 10 years of experiance welding stick. My first mistake was trusting this guy because of his "experiance". My second mistake was agreeing to help him when I was still new to welding. I had my mig tickets at the time, so my foreman asked me to tack up a train part while the new guy held it up. I had everything ready, than I had a gut feeling something bad was about to happen, so I turned around to grab some clamps. He let go of the steel plate... HE LET GO OF THE VERY HEAVY STEEL PLATE! Next thing I know the old guys I work with are rushing over, getting this part out of my boot and off my foot. Yes I was wearing steel toe boots, but the plate feel off the table at an angle and slid under my steel toe plate. The guys ended up sitting me down as I passed out. When I came too, my formen drove me to the hospital where I had to get the bottom of my toe stitched up because the pressure blew the bottom out. Doctor: Imagine your toe is an ice cube. Now smash that ice cube with a hammer, and that's your toe. I whent to work the next day because I'm stupid and figured it would show my dedication to earning an apprenticeship and show them I was willing to work through anything, even pain. The bones in the toe kept spreading, so I ended up getting constant infections causing me to need the first section of my toe removed about 6 months after the initial Injury. After my first surgery I noticed what was left of my toe was turning black and the bone was visible. They tried taking the dead skin off and giving me two stitches unmedicated, but the toe kept dying. I ended up getting the rest of the toe amputated. I've had a C-Section, and I'd much rather have another one, then going through a toe amputation again. That's how much pain I was in. I was off for 10 months. I got paid medical leave through WSIB, but I lost 10 months of hours, 10 months of traning, my tickets expired, they refuse to give me an apprenticeship now, I have to bag for jobs. My question: Do I have the right to compensation? I'm 27, never getting my toe back and my feet are in constant pain. Favoring one foot is causing the other issues. It's a back and forth battle. Because I'm young and have to still work on my feet for the next 40+ years, the doctors don't know how my feet will hold up. I'm not looking forward to the future and my mental health crashed because of all this.
